Accused Of Backing Bin Laden, Chicagoans File Suit

A "poison pen" e-mail that accused two local businessmen of being
supporters of suspected terrorist Osama Bin Laden is cutting a wide
swath through a Chicago-area community. 

On Monday, Irshad Khan and his uncle, Jafar Khan, filed a defamation
lawsuit, saying an e-mail being forwarded among area residents earlier
this month inaccurately alleged that the two kept a poster of Bin Laden
on the wall of the Mobil gas station they own in Naperville, Ill.  Named
in the suit is Benedictine University, an independent Roman Catholic
institution in neighboring Lisle, along with Benedictine's director of
public relations, and three "Does" yet to be identified who the Kahns'
lawyers believe fueled the rumor by word of mouth and e-mail.  Today,
the university said it has suspended its employee, Andri Kuhn, pending
an internal hearing, adding that Benedictine "has stood against racism
in all forms for more than 114 years."

The lawsuit, filed in Circuit Court in Dupage County, claims the rumor
that the Kahns were Bin Laden supporters appeared to have been started
by one of the "Does" - an employee of a nearby automobile dealership
identified only as "Greg."

The suit says that "Greg" told acquaintances that the Kahns kept in
their gas station a photograph and a flag celebrating the man suspected
of masterminding the Sept.  11 terrorist attacks on the U.S.  The Kahns'
lawyers said that the pair denied they displayed any such support for
Bin Laden, and that 22-year-old Irshad was born and raised in the
Chicago area, while his uncle has been a U.S.  resident for 22 years. 

The suit claims that, on Sept.  17, an individual known so far only as
"Marie" send an e-mail to an unknown number of recipients that read: "It
has been brought to my attention that the Mobil station on the corner of
Aurora and Ogden had a poster of Bin Laden out in front of the station
and flag apparently designating support for Bin Laden."

"Auto dealerships have already cut off their ties with this gas station
and I am urging you to do the same," the letter continued.  "I did get
this information first hand by someone who saw it just so you know." "It
is one thing to be unfairly treated just because of your race or
religion, but if you are going to advertise your support of this
atrocity, then I think you deserve to go out of business," the suit
describes the e-mail as saying.  "Please pass on this e-mail so we can
show this gas station that Americans don't stand for this." The lawsuit
says that, two days later, while using the e-mail systems of Benedictine
University, Kuhn forwarded to at least 28 individuals an "edited"
version of an e-mail similar to the one from "Marie." Kuhn's letter
added that the story had been verified by "a guy from the Jaycees I
belong to in Naperville."

That same day, the suit says, an individual known only as "Trish" sent
an e-mail to Exxon Mobil Corp.  saying she was "appalled that a station
in the USA would post a picture of Bin laden out in front..." "This is
not bogus," that letter continued, "it is verifiable with the Naperville
Police and the Naperville Jaycees." "Is this something that Mobil Oil
would allow?" that letter read.  "If so, cancel my credit card."

The suit also claims that, since the e-mail began circulating, the Kahns
had seen a "substantial decrease" in business at the gas station.  The
pair are seeking a judgment "in excess of $100,000" for the alleged
defamation and are seeking compensation for money lost by their business
because of the rumors. 

In a statement today, the university said its lawyers were still
examining the lawsuit, but that "what is known is that an ...  employee
took the personal step of passing along an e-mail that allegedly
contained false information."

"Whatever the cause, it is clear that the University's e-mail system was
used in a manner contrary to clear policy," it said.  Reported by
